TERMS AND CONDITIONS:

As of 12.02.2024

These General Terms and Conditions for events organized by Vision-z gUG apply to the purchase of tickets and attendance at events conducted solely by us or in collaboration with local organizers. At the same time, the house rules of the respective event venue apply. By purchasing and possessing a ticket to an event, the applicability of these terms and conditions is accepted.

 

TICKETS:

Tickets can only be purchased at www.startnext.com, www.eventim.de, and at the box office. The General Terms and Conditions of the aforementioned ticket platforms exclusively apply to the purchase of tickets.

ACCESS:

Infants and children under 6 years old are not allowed entry to the event grounds. Children between 6 and 14 years old may only attend the event accompanied by a person with parental authority. Adolescents between 14 and 16 years old are allowed to attend concerts until midnight with parental permission. The corresponding written permission must be presented upon entry. A template form is available here. For adolescents aged 16 and over, entry to concerts and music performances after midnight is permitted only with the accompaniment of a person with parental authority. Usually, parents are considered to have parental authority (not other authorized persons, such as an older friend). The aforementioned rules apply exclusively to concerts and not to any dance events within the event grounds. The legal provisions of the Youth Protection Act (JuSchG) apply, including on all park, access, entrance, and camping areas.

All valid admission tickets for the event (day and weekend tickets) will be exchanged for a festival wristband upon initial entry. The admission tickets will be invalidated during this exchange. The festival wristband will be attached to the visitor's wrist. Only the respective undamaged and original festival wristband entitles entry to the event grounds during the duration of the festival (day or weekend).

LIABILITY OF THE ORGANIZER:

The organizer's liability for damages of any kind is excluded. This exclusion does not apply to damages intentionally or grossly negligently caused by the organizer, in cases of simple negligence of the organizer resulting in injury to life, body, or health, as well as for the negligent breach of essential contractual obligations by the organizer. Essential contractual obligations are all obligations whose fulfillment enables the proper execution of the contract and on whose compliance the visitor regularly relies and may rely.

In cases of simple negligent breach of essential contractual obligations, the organizer's liability - with the exception of damages to life, body, or health - is limited to the typical, foreseeable damage at the time of conclusion of the contract or commission of the breach of duty by the organizer. In this respect, the organizer's liability for damages that are solely attributable to the visitor's risk area is excluded.

The above exclusions and limitations of liability also apply to the liability of the organizer for its officers, employees, and agents, as well as the personal liability of the officers, employees, and agents of the organizer.

ENTRY AND EXITING THE PREMISES:

Before entering the festival grounds or camping areas for the first time, the admission tickets required for this area are completely invalidated, and a wristband is placed on the visitor. This replaces the admission ticket. When re-entering the festival grounds, the undamaged wristband must be presented as an admission ticket. Otherwise, there is no entitlement to re-entry.

SECURITY CHECK:

For security reasons, there will be a security check with a body check by the organizer's security personnel at the entrance to both the campsite and the festival grounds. When entering the campsite, your luggage will also be checked.

 

The following items are prohibited on the festival grounds:

  • Any bags or rucksacks larger than 44 cm high x 38 cm wide x 30 cm deep

  • Drinks and liquids of all kinds

  • Firearms, bladed weapons, stabbing weapons and other weapons of all kinds

  • Fireworks, sparklers and other pyrotechnic items of all kinds

  • Laser pointers

  • Notebooks and tablets

  • Sound, photo and video equipment

  • Bulky items of all kinds, e.g. flagpoles, umbrellas (stick umbrellas)

 

Carrying the above-mentioned items may result in the visitor being refused entry to the event.

 

Only the following items may be brought onto the festival grounds:

  • Small belt and bum bags

  • Bags up to 44 cm high x 37 cm wide x 30 cm deep

  • Mobile phone

  • Wallet

  • Keys

  • Personal medication + toiletries

  • Small umbrellas (not stick umbrellas)

 

The following items are prohibited on the camping and caravan site:

  • Firearms, bladed weapons, stabbing weapons and other weapons of all kinds

  • Saws, axes, hatchets and similar tools

  • Pyrotechnic items of all kinds

  • Building and firewood

  • Substances and liquids that endanger water

  • Gas bottles outside of approved gas installations in motorhomes and caravans

  • Glass bottles and other glass containers

  • Acid batteries

  • Megaphones

  • Generators

  • Drones of all kinds

  • Barbecues of all kinds

  • Loudspeakers/music systems or similar

 

Only the following items may be brought onto the campsite:

  • Tents and accessories

  • Personal clothing and equipment

  • Food and drinks

  • Gas cartridges with a maximum capacity of 450g

  • Environmentally friendly yellow batteries approved for camping use

 

HEARING LOSS AND OTHER HEALTH DAMAGES:

The organizer expressly points out that events with music may involve increased volume levels. This poses a risk of potential hearing and health damage. The organizer is not liable for any hearing or health damage. Ear protection can be obtained from the security service for a small fee.

CANCELLATION, POSTPONEMENT, AND PROGRAM CHANGES:

In the event of cancellation of the event, there is a right to reimbursement of the ticket price without pre-sale fees. The refund will be made by the respective box office where the ticket(s) were purchased, upon presentation/return of the admission ticket(s).

In the event of cancellation, interruption, or postponement of the event, which the organizer is not responsible for (e.g., force majeure, closure, weather conditions, official orders, or judicial decisions, or restrictions due to the Covid 19 virus), the organizer will, as far and as soon as possible and reasonable, reschedule the event. In this case, the admission tickets remain valid, and there is no entitlement to a refund of the ticket price or compensation.

With the festival ticket, the visitor acquires the right to participate in the Reborn Festival with numerous live concerts and accompanying programs within the event grounds. Due to the large number of individual program items, program changes, cancellation, or omission of individual concerts, including announced headliners, cannot be ruled out. In these cases, the visitor has no claims against the organizer. Delays or time changes to individual program items (running order), especially those that arise during the ongoing festival event, must be accepted by the visitor. Any program changes will be announced promptly by the organizer. Depending on the timing of the change, the organizer reserves the right to announce it through publication on www.reborn-festival.de or via program announcements or announcements at the event venue.

The organizer's liability in the event of cancellation, interruption, postponement, or other significant changes to the event is limited to the reimbursement of the face value of the admission ticket. Personal costs such as travel and accommodation related to the event are at the visitor's own risk and will not be reimbursed by the organizer.

RIGHT OF WITHDRAWAL:

Consumers generally have a right of withdrawal. According to § 312g (2) No. 9 BGB, there is a right of withdrawal unless otherwise agreed, for contracts for the provision of services in connection with leisure activities if the contract provides for a specific date or period for performance. Accordingly, a right of withdrawal is also excluded for contracts that involve the sale of tickets for time-bound leisure events.

Consumers are entitled to a right of withdrawal under the following conditions, whereby a consumer is any natural person who concludes a legal transaction for purposes that cannot be predominantly attributed to their commercial or independent professional activity:

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, took possession of the last goods. To exercise your right of withdrawal, you must inform the organizer of your decision to withdraw from this contract by means of a clear statement (e.g., a letter sent by post or email). To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

If you withdraw from this contract, we shall reimburse you for all payments received from you, including delivery costs (with the exception of the additional costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than thirty days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

You shall send back the goods or hand them over to us without undue delay and in any event not later than fourteen days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of fourteen days has expired. You will have to bear the direct cost of returning the goods. You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.

 

WEATHER:

The event generally takes place in all weather conditions. If weather conditions pose a danger to the life, limb, or health of visitors, artists, or employees, we reserve the right to cancel the event immediately. In the event of a weather-related termination of the event, due to termination for other reasons of force majeure, official orders, judicial decisions, or restrictions by the Covid 19 virus, there is no entitlement to a refund of the ticket price or compensation unless gross negligence or intent can be attributed to the organizer.

 

CONSENT TO THE MAKING AND USE OF IMAGE AND SOUND RECORDINGS:

The visitor (meaning all genders) irrevocably and free of charge consents to the use of his/her image and voice. The organizer points out that the event may be filmed, photographed, and recorded. These recordings will be used by the organizer or authorized agents for advertising and promotion (internet, flyers, or similar).

 

PROHIBITION OF UNCONSTITUTIONAL SYMBOLS, SLOGANS, AND GESTURES:

The organizer does not tolerate any unconstitutional symbols, slogans, or gestures of any kind. Violations will result in the exclusion of the visitor from the event.

 

OUTSIDE PARKING AREAS:

Parking in the outdoor area is at the visitor's own risk, and the organizer assumes no liability for any kind of damage.

 

UNAUTHORIZED ACCESS:

Persons who unlawfully gain access to or remain on the festival and camping grounds will be reported for fraudulently obtaining services (§265a StGB) and trespassing (§123 StGB).

 

LIABILITY OF THE ORGANIZER:

The organizer's liability for damages caused by theft or damage of any kind to motor vehicles, tents, and other private items parked on the parking and camping grounds is generally excluded.

 

APPLICABLE LAW:

For all legal relationships between the parties, the law of the Federal Republic of Germany applies, excluding the laws on the international sale of movable goods. For consumers, this choice of law applies only to the extent that the protection granted by mandatory provisions of the law of the state in which the consumer has his habitual residence is not withdrawn.

 

JURISDICTION:

If the customer acts as a merchant, legal entity under public law, or special fund under public law domiciled in the territory of the Federal Republic of Germany, the exclusive place of jurisdiction for all disputes arising from this contract is the place of business of the seller. If the customer's domicile is outside the territory of the Federal Republic of Germany, the place of business of the seller is the exclusive place of jurisdiction for all disputes arising from this contract if the contract or claims arising from the contract can be attributed to the customer's professional or commercial activity. However, in any case, the seller is entitled to appeal to the court at the customer's place of business in the aforementioned cases.

 

ALTERNATIVE DISPUTE RESOLUTION:

The EU Commission provides a platform for online dispute resolution on the Internet at the following link: https://ec.europa.eu/consumers/odr. This platform serves as a contact point for out-of-court settlement of disputes arising from online purchase or service contracts in which a consumer is involved. The seller is neither obliged nor willing to participate in a dispute resolution procedure before a consumer arbitration board.
